Terms of sale
These are the terms on which Gracias a la Playa S.L. delivers TV channels to business customers. They are written to be read: what you are buying, what it costs, what you may do with the signal and what happens when something goes wrong.

01Parties and scope
These terms govern the delivery of live TV channels and related services by Gracias a la Playa S.L., Carrer Canaries 64 (1.6), 08800 Vilanova i la Geltrú (Barcelona), Spain ("we", "us") to the business customer named in the order ("you"). They apply to every order placed through this site unless a signed agreement between us says otherwise, in which case that agreement prevails.
The service is sold to businesses only. Nothing here is offered to consumers, and placing an order confirms that you act in the course of a trade or profession.
02How an order is formed
Selecting channels and submitting the order form is an offer to buy. The contract exists when we confirm the order in writing and issue the delivery endpoints, not when the form is submitted, because every order is checked against the rights we hold for the channels in it.
If a channel in your order cannot be licensed for your territory, platform or type of use, we tell you before provisioning and you may replace it or drop it without charge.
03Prices, discounts and VAT
All prices exclude tax. Orders are completed through our payment provider acting as merchant of record: it determines the applicable VAT from your billing country, applies the reverse charge against a valid EU VAT identification number where the conditions are met, and issues the invoice.
We may change list prices with 60 days written notice. A change does not affect the price of a channel already committed under a 12 or 24-month term for the remainder of that term.
- SRT delivery
- EUR 150 per channel per month.
- HLS / DASH adaptive
- EUR 200 per channel per month, CDN egress metered at EUR 0.09 per GB unless you use your own CDN.
- Hotel and hospitality
- EUR 40 per channel per month, per property, for in-room viewing in that property only.
- Add-ons
- MultiDRM EUR 19 (adaptive HLS / DASH only), cloud DVR and replay EUR 29, restart and start-over EUR 15, EPG and metadata EUR 9. Each of those is per channel per month.
- Volume discount
- Applied automatically: 10 - 24 channels 5%, 25 - 49 channels 10%, 50 - 99 channels 15%, 100+ channels 20%.
- Term discount
- 12 months 10%, 24 months 15%, applied on top of the volume discount.
- Set-up
- None.
04Billing and payment
Charges run monthly in advance from the day the endpoints are issued. Payment is by card or by bank transfer against an invoice, due 30 days from the invoice date unless the order states otherwise.
Late payment carries interest at the statutory rate for commercial transactions. If an invoice is more than 30 days overdue we may suspend delivery after written notice; suspension does not end the contract or the obligation to pay for the committed term.
05Term, changes and notice
A monthly contract renews each month and either side may end it with 30 days written notice, effective at the end of a billing month. A 12 or 24-month term runs for its committed length and then continues monthly on the same notice.
You can add channels at any time; they are billed pro rata from the day they are provisioned. You can drop channels from a monthly contract with the same 30 days notice. Channels inside a committed term can be exchanged for others of the same delivery type, but the number of channels cannot fall below what the term discount was granted for.
06Delivery, availability and support
Endpoints are issued the same working day for SRT and within 24 hours where DRM keys or a new playout are involved. Every channel is served from two core sites, and delivery edges home to the core site nearest them.
We target 99.9% monthly availability of the origin for each channel, measured at our hand-off point. The public internet between our hand-off and your receiver is outside our control; where you need a guaranteed path we will quote one separately.
Support is by email to the address on your order, answered within one working day, with a 24/7 escalation for a channel that is down. Planned maintenance is announced at least five working days in advance and scheduled outside European prime time where possible.
07Rights, territory and permitted use
You may use each channel only in the territory, on the platform types and for the purpose recorded in your order. Rights differ per channel and are set by the rights holder, not by us.
The hospitality rate covers in-room viewing inside the single property named in the order. It does not include distribution or redistribution rights, public-area screens beyond the rooms, or delivery to any third party. For most channels we can obtain additional rights on request and quote them per channel; until that is confirmed in writing, those uses are not permitted.
Recording, restart and catch-up may be used only within the window the add-on provides. You may not archive our feeds, re-transmit them outside the agreed platform, remove or alter DRM or watermarking, or make the signal available to anyone who is not a subscriber of the platform named in your order.
If a rights holder withdraws a channel or narrows its licence, we tell you as soon as we know, stop billing the channel from the date it stops, and help you replace it. That is not a breach of these terms.
08Trials
A trial provides one channel for 72 hours, with both an SRT endpoint and an adaptive HLS / DASH manifest, free and without a card. It is for technical evaluation on a closed network or in a lab. It may not be shown to the public, redistributed, recorded or used in a live service, and we may end it at any time.
09Your obligations
- Credentials
- Keep SRT passphrases, DRM credentials and portal logins confidential and tell us at once if they are exposed.
- Accuracy
- Keep your company details, VAT number and contacts current, as they determine invoicing and the rights validation.
- Capacity
- Provide the bandwidth and the receiving equipment your chosen delivery method needs.
- Compliance
- Hold whatever local licences your own distribution requires, and comply with applicable broadcasting and data-protection law.
10Liability
Each side is liable for direct damage it causes, capped for us at the charges you paid for the affected channel in the three months before the event. Neither side is liable for indirect or consequential loss, lost profit, lost audience or lost data, and nothing in these terms limits liability for death, personal injury, fraud or anything else that cannot be limited by law.
Neither side is in breach because of an event outside its reasonable control, including a satellite or fibre failure upstream of our ingest, a rights holder withdrawing a channel, or a general internet outage, for as long as that event lasts.
11Confidentiality and data protection
Prices, technical documentation and anything either side marks as confidential stay confidential for three years after the contract ends. Each side handles personal data as described in our privacy notice and, where we process personal data on your behalf, under a data processing agreement we will sign on request.
12Ending the contract
Either side may end the contract immediately if the other commits a material breach and does not fix it within 30 days of written notice, or becomes insolvent. We may suspend or end delivery immediately where continuing would breach a rights agreement or the law.
On termination your endpoints are withdrawn, charges up to the effective date remain payable, and any recordings held for you are deleted within 30 days.
13Governing law and jurisdiction
These terms, and every contract formed under them, are governed by the laws of Spain, to the exclusion of its conflict-of-law rules and of the United Nations Convention on Contracts for the International Sale of Goods.
Any dispute arising out of or in connection with these terms that the parties cannot settle between themselves is submitted to the courts of Barcelona, where Gracias a la Playa S.L. has its registered seat, and both parties waive any other forum they might be entitled to. This is without prejudice to any mandatory rule of law that assigns jurisdiction differently or that cannot be excluded by agreement.
If any provision is unenforceable, the rest stands.
